Scope of Application
1.1. The purpose of
this Privacy Policy is to define the activities undertaken by NoRecoil.Net with its
offical seat in ATLANTA, USA in the field of personal data protection and to
duly fulfill the obligation to inform on the processing of personal data to the
Data Subjects (such as customers and holders of an account on the website https://NoRecoil.Net/).
1.2. Personal data
is any information that may identify you, such as your name, telephone number,
postal address and e-mail address provided by you in the process of creating an
account on the website https://NoRecoil.Net/, or contained in the traditional and
electronic correspondence, as well as provided by you in the direct and
telephone conversations. When we refer to the term “to process” in the document
below, we mean all activities and operations performed on your personal data
(such as storing or analyzing for the purpose of providing you with our

free movement of such data, and repealing Directive 95/46/EC (hereinafter:
GDPR), with regards to personal data of natural persons.

Purpose, Legal
Basis and General Rules for the Processing of Personal Data
3.1. Personal data of natural persons (Data Subjects) are processed by the
Controller in order to:
a) conduct direct
marketing activities, including sending commercial information by means of
electronic communication, on the basis of consent given (as defined in the
Article 6 item 1 letter (a) of GDPR);
b) activate and maintain an individual user account on the website
https://NoRecoil.Net/, on the basis of consent given (as defined in the Article 6
item 1 letter (a) of GDPR);
c) the conclude, perform and on the basis of the contract on the purchase-sell
of the software (as defined in the Article 6 item 1 letter (b) of GDPR);
d) give an answer to the Data Subject’s question and maintain communication with
between the Controller and the Data Subject, on the basis of consent given (as
defined in the Article 6 item 1 letter (a) of GDPR);
e) establish, exercise or defend of legal claims, which is the Controller’s
legitimate interest (as defined in the Article 6 item 1 letter (f) of GDPR).
3.2. Personal data are being processed for the following period:
a) data processed
on the basis of the consent given – until withdrawal of the consent;
b) data processed in order to conclude and perform the contract – for the period
of the duration of the contract and after its termination until the expiration
of any claims arising from contract given.
3.3. Providing personal data for the purposes defined in the letters (a), (b)
and (d) of the Article 3.1 of this Privacy Policy is voluntary. If you do not
provide your details and do not give your consent we will not be able to provide
you information about our offer and promotions in the future, we will not be
able to set up and run your individual user account and we will not be able to
answer your questions and maintain communication with you.
Providing personal
data for the purpose defined in the letter (c)of the Article 3.1 of this Privacy
Policy is voluntary, however, it is a condition for the conclusion of the
contract. If you do not provide the data, we may refuse to conclude a contract
with you.
3.4. Data Subject’s
personal data are not exported outside of the European Union and the European
Economic Area.
3.5. Data Subject’s
personal data may be provided by the Collector to the following categories of
recipients: IT companies, analytical companies, accounting firms, advertising
agencies, law firms. Personal data may also be made available to relevant state
authorities at their request on the basis of relevant legal provisions.
Rights of the Data

4.1. Any person whose data is processed by the Controller has the right to
request from the Controller rectification or erasure of personal data or
restriction of processing of personal data concerning the Data Subject or to
object to processing based on the Controller’s legitimate interests .
4.2. If the
processing takes place on the basis of consent, the Data Subject has the right
to withdraw consent to the processing of personal data. Withdrawal of consent
will not affect the lawfulness of the processing that was made on the basis of
consent before its withdrawal.
4.3. The Data
Subject has the right to lodge a complaint with a President of the Personal Data
Protection Office (https://uodo.gov.pl/en), if he considers that the processing
of personal data violates the provisions of GDPR or other applicable laws on the
personal data protection.

5.1. Website
https://NoRecoil.Net/ uses “cookies” technology. Cookies are small text files

makes every effort to ensure all physical, technical and organizational measures

I. General Provisions
These Terms and
Conditions (hereinafter: T&C) define the general terms, conditions and rules for
sale of Products by NoRecoil.Net conducting business activity under name: NoRecoil.Net via
his online Store: https://NoRecoil.Net/ and specify the terms and conditions for
the provision of free electronic services by NoRecoil.Net.
Definitions of terms used in the T&C:
NoRecoil.Net – sole entrepreneur conducting business activity under name: NoRecoil.Net,
e-mail: NoRecoil.Net@NoRecoil.Net
Store or Website– NoRecoil.Net website https://NoRecoil.Net/ on which the Customer can
purchase Products sold by NoRecoil.Net.
Working Days – means days of the week from Monday to Friday, excluding Polish
public holidays.
Delivery – means the actual act of delivering the Product specified in the order
to the Customer by NoRecoil.Net.
Password – means a word or string of characters selected by the Customer during
the Registration of Customer Account on the Website in order to secure access to
the Customer Account.
Customer – means any person to which electronical services may be provided or
with which a legally binding contract may be concluded in accordance with T&C
and other relevant legal provisions.
Consumer – means any individual who purchases goods or services from an
entrepreneur not directly related to his/her business or professional activity.
Customer Account – means an individual panel for each Customer, launched on his
behalf by NoRecoil.Net, after the Customer has registered and therefore concluded the
contract of Customer Account Services.
Login – means an individual Customer’s identification, consisting of a words or
string of characters selected by the Customer, required together with the
Password to set up a Customer Account in the online Store.
Entrepreneur – means an individual, a legal person or an organizational unit
that is not a legal person which the law provides with legal capacity,
conducting business or professional activity on its own behalf and concluding a
legal action directly related to its business or professional activity.
Registration – means actual activity carried out in the manner specified in the
T&C and obligatory for the Customer in order to create his/her personal Customer
Account.
Product – means the product displayed by NoRecoil.Net on the Website, which may be
the object of a Sales Contract.
Durable Medium – means any instrument which enables the Consumer and NoRecoil.Net to
store information addressed personally to that consumer in a way accessible for
future reference for a period of time adequate for the purposes of the
information and which allows the unchanged reproduction of the information
stored;
Sales Contract – distance purchase-sale contract concluded between the Customer
and NoRecoil.Net on terms specified in the T&C and relevant provisions of Polish law.
